Returns & Refunds policy

Hello, Dear Customer, This is the official privacy policy and copyright page of Sutrakatha. There may be changes in the future according to legal policies; read carefully as per your surveillance.

Policy Overview

Sutrakatha Ethnic Wear specializes in handcrafted and fully customized ethnic clothing. Each garment is made-to-order, featuring unique fabrics, traditional techniques, and individual measurements. Due to this bespoke nature, our policies strictly uphold artisan value and Indian legal regulations on returns, refunds, and protection of intellectual property.

No Return/Refund on Custom & Handmade Products

  • Custom-made and handmade ethnic wear cannot be returned, exchanged, or refunded once purchased, except in the rare case of a proven and significant manufacturing defect or shipping damage.

  • Products falling under the “customized” category are exempt from general e-commerce return rights per the Indian Consumer Protection Act, 2019 (Section 2(47)) and standard textile regulations. ethnicattirebychetna

  • Variations in weave, embroidery, or colors are an inherent part of handcrafted textile processes and do not constitute defects.

Legal Foundation

  • This policy is supported by Article 19(1)(g) of the Indian Constitution (right to trade), the Indian Contract Act, 1872 (binding agreements), and the Textile Committee Act, 1963 (quality compliance for handmade goods).

  • GST compliance: As per Central GST Act, 2017, once a sale is confirmed and invoiced, no GST refund or reversal is allowed for customized goods unless returned in original condition—which is not possible for uniquely tailored products. Indian traditional wears

Exception

  • If the delivered product is damaged during shipping or is not as ordered (after valid photographic evidence within 48 hours of delivery), Sutrakatha will offer free alteration, repair, or partial replacement, at our discretion—no cash refund will be issued. ethnicattirebychetna

Exchanges, Cancellations & Warranty

  • Orders may be canceled before production begins. Post-confirmation, cancellation is not permitted due to resource commitment to each garment.

  • For alteration requests, Sutrakatha may offer tailoring adjustments within reasonable scope, with shipping costs to be borne by the buyer if returned for alteration.

    • Under section 15 of the Copyright Act, artistic works not registered as designs lose copyright protection after 50 replications, meaning handmade exclusives remain protected unless mass-produced.

Prohibited Actions

  • Any attempt to produce or sell replicas, digital copies, or unauthorized derivatives will result in legal action, including injunctions and monetary damages, per the Copyright Act, 1957, and the Design Act, 2000.anandandanand+1

GST and Invoice Compliance

  • All purchases receive GST-compliant invoices. No refund or GST reversal will apply after dispatch of made-to-order goods unless legally mandated.

  • GST credit notes, adjustments, or reversals do not apply to custom-made, non-returnable apparel unless a court-reviewed refund is processed.

Artisan Protection & Brand Ethics

  • Sutrakatha supports Indian artisans and sustainable textile traditions protected under Article 43 of the Indian Constitution (Directive Principles).

  • Liberal returns and design infringement harm both cultural preservation and the livelihoods of craftspeople; this policy exists to safeguard both.

  • By purchasing, customers agree to respect artisan rights, design originality, and all relevant textile and copyright laws.
